Terms

"We, Us, Our" pertains to Blokefromhull Designs.

"You, Your" pertains to the customer/client.

Payment for Service:

Payment is due no later than 5 working days after we notify you. Some projects may require a partial payment in advance - you will be advised of this where applicable. Failure to pay the agreed fee within the agreed timeframe will result in the website being unpublished. Extended periods (over 28 days) of non-payment may result in the project being deleted in its entirety. This excludes cases where we make changes or modifications to existing sites, in which case these changes will be reversed. PLEASE NOTE at this time we currently only accept payment via Bank Transfer or Cash (if local). Details will be given when payment is due.

All prices quoted exclude the domain cost and Wix premium fees (shown here). The appropriate Wix Premium package will be discussed prior to starting the project, so you will be aware in advance of the approximate pricing. Activation of the premium package will be your responsibility - however we will provide instructions and assistance where needed. It is done by simply logging into your Wix account, selecting your site and clicking "upgrade". Doing this allows you to control your own subscription and payment information without having to pass it on to us. This dashboard will also be the platform you log into for stock management for any online stores.

Content:

On approving any designs or finalised projects, you agree to accept responsibility for any content, including (but not limited to) any text, images, links, references and contact details. Once designs have been finalised and approved by the customer, Blokefromhull Designs accept no legal responsibility for any of the content included in our projects. Should you own any content included on one of our projects and require it to be removed, please contact us immediately.

Performance, Downtime & Permissions:

We endeavour to provide the best performance possible for your website. However some things are out of our control, and as such, we cannot accept any responsibility for the following:

  1. Uptime/downtime of services provided by the domain host

  2. Uptime/downtime of the Wix platform

  3. Advertising performance, social media performance or any associated business performance relating to work undertaken by us - this includes any feedback, reviews and ratings

  4. Lost revenue relating to any items offered for sale on your website

  5. Communication issues (unless in the unlikely event we have made a mistake with any contact details)

  6. Configuration or management of payment methods for your website

  7. Use of copyrighted media, or use of copyrighted logos/trademarks. We may ask for proof of ownership or permission in certain cases.

What's included in our service (varies according to services requested):

  • Website design and build, or maintenance to your existing site (only on the Wix platform)

  • Configuration of domains, email/web forwarding and Wix Premium packages as necessary

  • Listing your site with search providers including Google and Bing

  • Management of your business or organisation's Google Business listing, where requested

  • Maintenance and/or management of social media accounts, where requested

  • Logo design if requested (this is a limited service as we don't offer full graphic design services)

  • A copy of all files used in the project on a new USB stick, mailed directly to you, if requested (fee applies)

What's NOT included in our service:

  • Paid marketing campaigns through third parties, such as Google, Facebook etc

  • Configuration, adjustment or maintenance of hardware or software at "your end" (though we may be able to offer advice)

  • Any royalties or fees due for copyright content contained on your sire. This may include images, videos, audio or use of logos and trademarks.

  • Payment of any third party services not pre-agreed, such as Wix subscription/app upgrades, mailboxes, additional domains, etc.

  • Creation or listing of items for sale via the website, or control of stock for these items.

  • Configuration or management of payment methods for your website

  • Management of email programs, mailing lists, offers, invoices or other sales/marketing media available on your Wix account

  • Ongoing maintenance, other than functionality adjustments for up to 60 days after site approval (unless you sign up for a maintenance agreement)

This privacy policy will explain how Blokefromhull Designs (referred to herein as "Our Company", "Us", "Our" or "We") uses the personal data we collect from you when you use our website:

What data do we collect?

We may collect Personal identification information (Name, email address, phone number). We will never request or collect sensitive information, and financial information will only be requested should we need to send you funds via bank transfer (this data will not be stored once any transactions have been completed).

How do we collect your data?

You directly provide us with most of the data we collect. We collect data and process data when you contact us regarding any of our products or services, and when you use or view our website (via your browser’s cookies).

How will we use your data?

Our Company collects your data so that we can contact you should you complete our form and request communication from us, or so we can tailor any quotes, services or recommendations as requested by you.

How do we store your data?

Our Company securely stores your data digitally and/or on hard copy, both of which will only ever be accessible by authorised personnel and only when they have a reason to access the data according to GDPR legislation.
